- Loan Modification: Banks have been notoriously slow with loan modifications. Homeowners may find the sale date looming and they can't get anyone at the bank to respond. If this is the case for you, or if your outstanding debt is preventing you from qualifying for a loan modification, and you qualify for a Chapter 7 or Chapter 13 bankruptcy, filing for bankruptcy will put a temporary hold on the foreclosure sale. This gives you more time to negotiate with the bank.
- Bankruptcy Filing: A bankruptcy stay of foreclosure is only temporary. If you can't afford your home even with the help of a debt repayment plan in Chapter 13 or discharge of debt in Chapter 7, your best option may be to sell the house so you can keep any equity you've accumulated over the years and/or to possibly avoid a deficiency.
