Failure to Disclose

One of the major sources of disputes in commercial and residential real estate sales is failure to disclose. California requires disclosure. There is a form. There is a process. Unfortunately, sellers may attempt to use the "as is" clause in order to get around mandatory disclosure. They may fail to disclose known defects.

When the buyer discovers the defect that was not disclosed, he or she may have the right to take action. Defects may include roofing issues, mold issues, plumbing issues and more. These defects can be extremely expensive to repair, and repair tends to be a necessity. The buyer may seek compensation for damages suffered because of the seller's failure to disclose.

These cases may also involve action against the real estate agent. Real estate agents have a duty to disclose all details to both parties. However, the real estate agent is working on commission. It is in his or her best interest to close the sale as quickly as possible. In order to do so, proper disclosures may not be issued. Real estate agent failure to disclose may be at the heart of a residential or commercial real estate dispute.

Breach of Contract

A residential or commercial real estate transaction may come to a halt if the buyer backs out. While the buyer may lose the deposit, the seller stands to lose a substantial amount of money. The seller may take action against the buyer to recover damages.
