Who Is the Benefactor of the Trust?
Many trust disputes begin the same way: The person who created the trust passes away. One or more members of that person's family discover that they have not been named as benefactors of the trust, or that someone has been named a benefactor who should not have been. Allegations of undue influence often arise.
Cases may involve a family member who stepped in as a caretaker late in the deceased person's life, leading to the caretaker being named sole benefactor while the rest of the family is ignored, or while the rest of the family receives substantially less money. Breach of Fiduciary Duty
Another major cause of trust disputes is allegation of the successor trustee mismanaging the trust's assets. This is a person who gets paid to manage the trust. Often, these cases are made challenging because the breach of fiduciary duty may not come to light until a child benefactor reaches the age of 18, only to find that the trustee has lost all the funds in the trust and there is nothing left.
